Detroit Gun Instructor Creates Seminar To Address Accidental Child Shootings

LAID - November 24, 2014 - DETROIT --Over the last month, four children in four separate incidents were seriously injured in metro-Detroit when they gained access to an unattended firearm in a home.
Accordingly, "Legally Armed In Detroit" will be organizing a 3 hour presentation on how parents can effectively own guns to defend their homes while also responsibly safeguarding their guns from children.
The express purpose of this event is to educate the community how to own firearms while responsibly keeping their children safe.
This program will be of special interest to the following people:
- Parents with both guns and children in the home.
- Parents with children who want to buy guns.
- Parents of children who visit the homes of others.
The agenda will be as follows:
- Rick Ector, an NRA credentialed Firearms Instructor, will be opening the session with an introduction to fundamental safety.
- A 45 minute "Project Childsafe" video from the National Shooting Sports Foundation on firearms in the home will be played. The presentation will be moderated by Michigan Gun Owners.
- Terry Johnson, a local attorney with a specialty in Firearm Law, will be providing a primer on the legalities and the responsibilities of having a gun in the home.
- Q & A
The first 50 registrants of this program will receive a FREE gun cable lock. The locks were donated by Michigan Open Carry, Inc and the Algonac VFW.
Registration to this event will be capped at the first 60 people to officially register via the link below. The link will take you over to Eventbee to finalize your registration.
Parents are encouraged to also register a child to come along with them.

What Would Your Kid Do (If He Found An Unattended Firearm)?

It's Thanksgiving Holiday Weekend - 2014. School is out and you have time off from work. Your family is bustling with activity: making travel plans, planning the big dinner, and wondering if the Lions are going to lose another nationally televised game.

Your sibling with children the same age as yours offers to babysit for a night. Your child packs a bag and goes to a sleep-over. Your child and your sibling's child play a litany of games including Hide-and-Seek. Your child looks under a bed and sees an unattended and loaded firearm. What Would Your Kid Do?

Have you even talked to your child about firearms? Maybe you don't even like guns, don't own any, and don't have any plans to buy any. Maybe you even shared your disgust with them to your child. Maybe your child is curious about firearms. Or rather, maybe your child doesn't think about them at all UNTIL he is looking at one unattended under a bed.

Your child may come across a firearm one day even if you don't own one. In short, I am suggesting that you talk to your child about guns. However, maybe you don't know much about them. Further, you might not have a clue as to how best to approach the subject. Some people think that if they talk to their kids about a topic that exchange may be enough to encourage curiosity.

Ignorance kills. Don't believe me? I read a few local stories over the last month or so about how a few young children came across unattended guns in a home. In each case, the child was injured. One, managed to kill himself.

Alternatively, you might actually be a gun owner. You bought the gun for home defense and personal protection. You may or may not have a concealed pistol license. In either case, you still are responsible for knowing firearm safety, for safeguarding your guns from unauthorized users, and being able to balance the aforementioned concerns with accessibility just in case someone dares to invade your home while you and your family are there.

If you have children. You need to talk to them about guns. You also need to do a bunch of other things. The right to keep and bear arms comes with a lot of responsibility. A big one, of course, is not allowing your child to shoot himself.

This Saturday, November 29th, we will be conducting a seminar to address the subject of guns and kids: firearm safety, firearm education, firearm storage, and firearm law. We will cover everything you need to know about being a responsible gun owning parent.

Make plans to join us. The seminar is only three hours long and only costs $29. Attendance is limited, so register early.

Q: Rick, Will being diagnosed with dyslexia disqualify me for a CPL?

A. First and foremost, I am not a mental health professional who is the only person that can make a diagnosis of a mental illness. 

However, as I understand it, dyslexia is a developmental learning disorder and is not a "mental illness." Of course, I am not a doctor and neither are the members of the county gun boards. If you are denied for a Concealed Pistol License (CPL) because you have been diagnosed with having dyslexia, I would strongly urge you to hire a lawyer and to consider appealing the denial.

Violent Attack: Comply or Fight Back?

Most of you are well aware that I am a Firearms, Personal Protection, and CPL Instructor. As such, some of you may take my positions on self-defense with a grain of salt - or two.
For one, I have never made any guarantees about what someone armed with a gun for personal protection can do with certainty. However, I do highlight from stories in the media what others have done. I believe that if a task - like protecting yourself - can be done by others, then you can do it too.
Of course, there is a price to be paid to be able to get it done, like any other worthwhile task. In this case, you will need training, a firearm, and practice.
Second, I want to also appeal to your sense of logic. I want you to see what the statistics say about you being able to avoid and escape injury from predators if presented with an attack.
In one study - "The Value of Civilian Handgun Possession as a Deterrent to Crime or a Defense Against Crime" by Don B. Kates Jr. - the rate of injury for victims based on their actions is the following:
- If the victim cooperates, the injury percentage is 24.7
- If the victim tries to reason with the attacker, the injury percentage is 30.7
- If the victim tries to run away or evade, the injury percentage is 34.9
- If the victim tries to get help, the injury percentage is 48.9
If you knew these stats, you could understand why some police officers or law enforcement agencies routinely suggest that citizens just capitulate when presented with an assault, robbery, or a car-jacking.
The dirty little secret is that the injury percentage for citizens who resist with a firearm is only 17.4 percent.
The safest course of action is to legally carry a firearm and defend yourself. It is completely logical and rational to carry a gun for personal protection.
Not resisting is safer than some alternatives. The big question is whether you are ready to invest money, time, and effort to significantly lower your injury odds from complying down to the significantly lower odds of fighting back with a pistol.
Stated simply, you have a 41 percent greater chance of being hurt by not resisting than defending yourself with a gun.
If you are motivated by logic, data, and facts, you will agree that citizens not wanting to be hurt should legally carry a firearm.

Bad Personal Protection Tip: If You Have To Shoot Someone, Afterwards Drag Them Into The House
A persistent and troubling personal protection tip that I first heard during my youth and that I continue to hear today - and I am sure that you have heard it too - is that if you have to shoot someone you should consider dragging them into your house. 

Presumably, this woeful and questionably legal tactic was first created and shared during an era when self-defense laws around the country were more stringent than they are today. Not too long ago, persons who opted to use firearms to defend themselves and their families while at home from an intruder often found themselves in legal trouble.

Many states had laws on the books that officially recognized self-defense but still required armed homeowners to retreat from danger even while in their very homes. In some extreme cases, homeowners were so concerned about being prosecuted that they retreated into the furthest room of their residences and climbed through opened windows to go outside and not risk a confrontation with a dangerous criminal which even if he survived may cause him to be later convicted of a serious crime.

So, it is not too hard to imagine the grief and angst a home owner might feel about defending himself on his property outside of his home. Thus, an urban legend was born. Under the circumstances of that day and age, shooting a perceived threat and dragging him into your home offered some legal but tenuous cover. If the shooting could be staged to look like it really happened after a break-in, it could - in theory - gain sympathy from the community, investigating law enforcement officers, and the local prosecutor. Personally, I have never heard of someone actually trying this gambit.

For the record, if you shoot someone outside of your home while on your property, do not "drag the body" into your home. Forensics, blue lights, and professional investigators should be able to determine if the evidence doesn't look right. Furthermore, attempting to stage a crime scene could garner additional penalties and charges: Obstruction of Justice, Tampering with Evidence, and Making False Statements.

Fortunately, in Michigan and many other states today the lethal force and self-defense laws have changed over the years to level the playing field for the benefit of upstanding citizens who are attacked by violent criminals.

For one, the Castle Doctrine became law in Michigan in October of 2006. If someone invades your home, it is presumed that a reasonable and imminent danger exists and there is no "Duty to Retreat." However, the presumption has exceptions and is rebuttable by the local prosecutor to prove beyond a reasonable doubt that no danger existed.

Secondly, many states such as Michigan have also extended the Castle Doctrine beyond the home to include any place a citizen has a legal right to be. The net effect is that if a person is presented with a reasonable and imminent threat to his safety, he does not need to flee the area before defending himself. Of course, there are other qualifying considerations but they are outside the scope of this safety tip.

In all, if you know and understand the lethal force and self-defense laws of your state and your local area, you do not ever need to be dragging bodies after defending yourself. However, it seems that many people need to be updated. As an active Firearm Safety and CPL Instructor, I know that many people still believe that moving dead bodies is a good idea.

Bad Personal Protection Tip: Having A Vehicle Trunk Escape Plan
While attending a Detroit Police Department Quarterly Town Hall Meeting a few years ago, I was first exposed to the most intriguing bit of personal protection advice I had ever heard to date. The tip has extremely limited application as it is only relevant if the victim has been kidnapped and thrown into a vehicle's trunk.
The solution, as told at the aforementioned meeting, is to kick out the rear vehicle's tail lights with your feet from inside the trunk and to subsequently extend your hand through the opening. Allegedly, other drivers on the road will see this odd sight and will intervene in some fashion to aid you in your escape.
At first blush, I thought the tip was helpful. The very first thing that I did after meeting was to open my vehicle's trunk while still in the venue's parking lot and to see if this idea had merit. Unfortunately, my vehicle's rear lights were not accessible from inside the trunk. Undaunted, I checked - with permission - the interiors of car trunks of family members and friends. I could not locate a single vehicle in which the tactic could be applied.
A far better tactic in this situation - being stuffed into a trunk against your will - would be to locate the glow-in-the-dark interior trunk release handle which was mandated by the federal government to be installed in all cars sold in the US in the year 2002 and afterwards.
This escape tactic, of course, would only be applicable if the kidnapper did not cut or disable the handle and its associated cable before abducting you. Moreover, all of this Houdini-esque trickery is all for naught if the bad guy had the presence of mind to bind you with rope or duct tape before throwing you in the trunk.
Most people who are abducted and thrown into a trunk are never later seen alive. Once a bad guy has taken his victim away from the primary crime scene, the victim's odds of surviving the incident plummets. The eventual destination will be a secluded location where no potential witnesses will be able to see or hear what the abductor has planned for his prey.
Thusly, the only rational tactic is to avoid being put in the trunk in the first place. Well, how exactly does one do that? By any means necessary do not allow someone to abduct you. You should fight as if your life depends on it because it does. A common objection I hear about this tactic is the possibility of the abductor having a gun or other weapon and threatening to shoot you with it.
If he wants to shoot you and has the means and the opportunity, he will shoot you - then and there. It is better to be shot in your own driveway than to be left - shot and alone - in some alley or deserted industrial district. At the very least, if you do get shot there is a good chance that you will survive - depending on how many times you are shot and how fast you can get to a hospital.
Avoidance is always the best policy with respect to personal protection. Good decision making is also a helpful trait. Do not engage in any activity that will put you at a greater risk for being attacked or abducted. However, despite our best efforts to reduce the likelihood of being attacked violent crime may still present itself. Thus, you should prepare for it and know before-hand what you are willing to do when it happens. If you don't have a plan, get one before you need one.

Bad Personal Protection Tip: Complying During An Attack Is The Safest Response To An Attack
A few days a man was brutally carjacked at a Mobil gas station near the intersection of McNichols and Telegraph, according to a news report by Fox2 News. The victim was hit in the head numerous times, body-slammed, and kicked in the head before the two assailants made off with the vehicle.
In the report, a Detroit Police Dept. officer made the following statements:
"This assault was violent in nature because the victim resisted. Had he not resisted - if he simply complied - it (the assault) would not have gone to the extent we saw (on video). Fighting back - we (Detroit Police Department) do not believe that it is the best thing to do. We recommend you to surrender the vehicle. It is the safest thing to do. Let's face it, a vehicle is not worth your life."
I respectfully disagree with the Detroit Police Department. Yes, a carjacking is a violent crime. Force was being used to deprive him (the victim) of his property, however, the threat is not to the property. The threat is to the person. The victim was hit in the head several times, body-slammed, and kicked in the head before the predators left with the aforementioned property.
The Detroit Police Department, if they are honest, will admit that even if selected victims, comply with every task asked of them by their attackers, there is no guarantee that they will not be harmed. Do a Google search on Detroit robberies to confirm my assertion.
Secondly, the spokesman for the Detroit Police Department was not completely forthcoming when he stated that complying was the safest thing for selected victims to do. In fact, compliance to armed robbers is not the safest response.
One study done by Don B. Kates Jr - The Value of Civilian Handgun Possession as a Deterrent to Crime or a Defense Against Crime - demonstrated the following injury statistics for victims based on how they reacted to being attacked:
- Victims who resisted with a firearm were injured in 17.4 percent of attacks.
- Victims who fought with a weapon other than a gun or a knife were injured in 22.2 percent of attacks.
- Victims who complied were injured in 24.7 percent of attacks.
So, the point of the aforementioned study is that complying with an attack is not the safest thing you can do. The safest thing you can do is to legally carry a firearm and be ready, willing, and able to use it. The police for whatever reason don't want to tell you that. Maybe they're scared you might do it.
Finally, doing what the police say regarding your life during an attack on your safety is your decision. It's your life. You will have to live with the consequences. There are no guarantees, even if the police imply that one exists.
If you want to comply and risk getting hurt anyway, then do so. If you want to take your chances defending yourself with a firearm and have an even better chance of not being injured versus complying, then do so. Whatever you choice you elect, make your decision without the police telling you what to do.

Ramapo College (NJ) recently sponsored an hour-long seminar to educate its students about rape. Among the info shared with students was the suggestion that "women need to watch their body language and that women should practice how they articulate their face by practicing in the mirror. "

The info was widely derided in social media as an "Anti-Rape Face." Many detractors went so far to say that women were being blamed for the assaults upon them by unwittingly inviting the rapist to attack.

No woman asks to be raped, especially not by a subliminally delivered facial expression. If I was king, all women on college campuses would be issued firearms, given training on how to use them, and be allowed to carry them on campus. Nobody asked me.

Bad Personal Protection Tip: Shoot A Firearm Through A Door
In February of 2013, VPOTUS Joe Biden had an interview with "Field and Stream Magazine" in which he gave the following advice: "[if] you want to keep someone away from your house, just fire the shotgun through the door."
Biden's advice was ill-advised. In many communities across our country, including the state of Michigan, lethal force for personal protection is only legal under a narrow band of circumstances. For example, in Michigan, a provision in the law - The Castle Doctrine - has a presumption that someone who has unlawfully invaded a residence is an imminent threat of great bodily harm.
The Castle Doctrine in Michigan has some exceptions and is rebuttable by the county prosecutor but it certainly does not authorize shooting someone through a door for just being on someone's porch.
Moreover, every state has it's own laws on lethal force and self-defense; each state's laws needs to be studied and understood by anyone contemplating the possibility of using lethal force in their locale. Biden's advice is not "one size fits all."
In metro-Detroit, this scenario actually happened whereby a man was convicted of Second Degree Murder for shooting a woman through a door. He was convicted, in part, because he could not prove under Michigan law that he was in imminent danger. That is a huge mountain to climb when you are on the other side of a door from someone who might be a threat.

Bad Personal Protection Tip: Shoot A Shotgun From Your Balcony
IIn February of 2013, VPOTUS Joe Biden appeared on an online Facebook town-hall in which he shared some questionable personal protection advice.

He was quoted as saying the following to a woman named Jill on the subject of gun ownership: 

"Nobody needs an AR-15, especially women. If you want to protect yourself, get a double-barrel shotgun. Jill, if there's ever a problem, just walk out on the balcony here ... walk out and put that double-barrel shotgun and fire two blasts outside the house.’ … You don't need an AR-15 — it's harder to aim, it's harder to use, and in fact you don't need 30 rounds to protect yourself. Buy a shotgun! Buy a shotgun!"

First, in many localities such as the state of Michigan, it is illegal to haphazardly discharge a firearm into the air. Doing so, could net the user either a "Reckless Discharge of a Firearm" charge or a "Discharge of a Firearm Inside of City Limits" charge. In short, so-called "Warning Shots" are usually illegal.

Moreover, since slugs or shot are subject to the laws of gravity, they must fall somewhere. It is possible that the projectiles could harm human life or damage personal property. Losses of life or property will certainly garner additional charges.

Furthermore, a firearm should only be discharged for personal protection purposes when the operator is in reasonably imminent danger of great bodily harm, sexual assault, or death.
