FAQ: Is It Unlawful For Me To Conceal Carry My Firearm While In The Presence Of A Felon?

Q: I recently started carrying two firearms. When I drive I usually keep one on my hip and the other under my seat or on my lap. My brother often rides in the car with me (he is a convicted felon). My question is what will happen if I'm stopped by police with two guns in my vehicle and they realize my brother is a convicted felon? will I be in trouble for having him with me or having guns around him? Thanks in advance Rick

A: As you are aware, it is unlawful for a felon to be in possession of a firearm. It is also unlawful for a person to knowingly give a firearm to a felon. Thus, if you are armed and you are in the presence of a felon, you must exercise due caution that your brother does not have possession or access to your firearm. For example, if you exited your vehicle while leaving both your brother and a firearm behind, the two of you could be in legal trouble. So, be careful and use your best judgement.
