Michigan CCW Class: How To Legally Transport Your Handgun On An Airplane

One benefit of having a state of Michigan issued Concealed Pistol License (CPL) is that the named person can take his concealed pistol with him on vacations and business trips.

Most people, when informed of this benefit, automatically assume that the mode of transportation is just limited to travel by car. The purpose of this post is to document how a person can legally take his pistol with him while traveling by plane.

Determine Whether Your Handgun Concealed Carry License Is Recognized

The very first thing that a Michigan CPL-holder should do before making plans to travel with a concealed handgun is to check if the destination state honors CPLs from Michigan. Currently, there are 35 other states in our country that have firearm carry reciprocity with Michigan.

Firearm reciprocity agreements are maintained for the state of Michigan by the Attorney General's Office. Thus, gun-owning travelers should consult the MI AG's web site to see if our state has reciprocity with the destination state. If there is reciprocity between the destination state and Michigan, the traveler can assume with confidence that he can take his firearm there while visiting.

However, travelers should keep in mind that firearm laws in other states may differ significantly from the laws on the books in Michigan. It is the traveler's responsibility to visit both the destination state's Office of the Attorney General and the destination state's State Police Department to learn the legal responsibilities of carrying a pistol in that destination state.

Moreover, in some cases where there is firearm carry reciprocity between our state and others, travelers may need to research local city firearm laws in the destination state. For example, Michigan has firearm carry reciprocity with North Carolina (NC) but individual cities in NC may have stricter laws in effect than at their state level of government.

Further, please also be mindful that it is not lawful to attempt to take a handgun across an international border without being granted specific permission. Thus, do not travel with your handgun if your intent is to visit another country (e.g. Canada, Mexico, and etc.) if you don't have documentation from that country authorizing you to do so.

Consult With The Transportation Safety Administration (TSA) For Firearm Rules On Aircraft

The Transportation Safety Administration (TSA) is a federal agency that has the responsibility of ensuring that our nation's transportation systems are safe for travel and commerce. Accordingly, they have rules in effect regarding the transportation of firearms aboard commercial aircraft.

Thus, the TSA's web site should be consulted by travelers whenever planning a trip with firearms to ensure compliance with federal laws and guidelines. These regulations are strictly enforced. Violations can result in criminal prosecution and civil penalties can be as high as $10,000 per violation.

As of today's date, the TSA's rules for flying with firearms are listed as the following:
  • Firearms, ammunition, and firearm parts may only be transported in checked baggage.
  • Firearms, ammunition and firearm parts are prohibited from carry-on baggage.
  • Travelers must declare all firearms, ammunition, and parts to the airline during the ticket counter check-in process.
  • Black powder or percussion caps used with black-powder are prohibited.
  • The firearm must be unloaded and must be in a locked hard-sided container.
  • TSA inspects all firearm cases at the ticket counter. Travelers should remain in the area designated by the aircraft operator or TSA representative to take the key back after the container is cleared for transportation. If travelers are not present and the security officer must open the container, TSA or the airline will make a reasonable attempt to contact the owner. If contact is not made, the container will not be placed on the aircraft.
  • Travelers must securely pack any ammunition in fiber (such as cardboard), wood or metal boxes or other packaging that is specifically designed to carry small amounts of ammunition.
  • Travelers may not use firearm magazines/clips for packing ammunition unless they completely and securely enclose the ammunition (e.g. by securely covering the exposed portions of the magazine or by securely placing the magazine in a pouch, holder, holster, or lanyard).
  • Ammunition may be carried in the same hard-sided case as the firearm, as long as it follows packing guidelines described above.


Consult With The Specific Airline For Their Firearm Rules

Once the traveler has booked his flight arrangements with an airline, he should consult with their web site for any company specific requirements. Rules for flying with firearms are not uniform across all airlines.

As an exercise, I visited the Delta Airlines web site today and found the following info:
  • We do allow small arms ammunition, in quantities not exceeding 11 lbs. (5 kg) per person, as checked-baggage only. The weapon must be securely boxed and intended for that person's own use. More than one passenger may not combine quantities into one package.
  • Gunpowder (e.g., Pyrodex, black powder, mace, pepper spray, and tear gas) is never permitted.
  • Firearms are permitted as checked-baggage with special requirements.
  • More info on firearms on Delta Airlines planes


Flying Domestically With A Firearm Is Legal But Requires Homework

If it is important to a traveler to take his firearm with him while flying, he should take the appropriate amount of time to learn how to do without running afoul of laws in both the destination state and the destination city, without violating federal TSA rules, and without skirting airline specific rules.

Flying with a handgun is legal if you follow all of the guidelines, rules, and laws.

Detroit Firearms Instructor distributes 1,750th personal protection video clip to popular social networking web site.

Detroit Gun Rights Advocate Plans Open Carry Meetup At Largest Free Country Music Festival in The World

Detroit, Michigan -- May 13, 2011 -- Detroit Open Carry Advocate plans a meetup of law-abiding visibly armed citizens at Country Music Hoe Down Festival.

Rick Ector, Operator of Internet blog "Legally Armed In Detroit" (LAID) has planned an Open Carry Meetup for this Sunday - May 15th - at Hart Plaza in Detroit. Fifty (50) armed participants are expected to be in attendance for the event which will start at 1:00 p.m. at the landmark Fountain.

The purpose of this meetup, as explained by Ector, is to raise awareness of the legality of Open Carry in Detroit and to exercise a right many feel that is constantly under attack. Ector states, "There are thousands of law-abiding, tax paying, and voting residents in Detroit who are proud gun owners. We are planning to have a peaceful gathering while proving that Detroiters can behave lawfully with firearms in their possession."

In general, it is legal in the state of Michigan for a person 18 years of age to display his own registered pistol in a completely visible holster without a special permit, as long as he does not venture into a state designated pistol-free zone. Since this event was issued a liquor license by the state, all open carriers are required to have a Concealed Pistol License.

The 29th Annual Country Music Hoe Down at Hart Plaza is currently billed as the largest free country music festival in the world. It is that estimated 800,000 to 1,000,000 persons expected to attend the festival over the three-day weekend.

Repost: The Reason Why You Might Not Be Able To Open Carry At This Weekend's Detroit Country Hoe Down

This ensuing weekend - tomorrow through Sunday - the city of Detroit will play host to the 29th Annual Country Music Hoe Down at Hart Plaza. The event is currently billed as the largest free country music festival in the world.

Among the estimated 800,000 to 1,000,000 persons expected to attend the festival over the three-day weekend will be law-abiding gun owners who actively carry a firearm. In the state of Michigan both concealed carry and open carry of a firearm is legal and both will be practiced by some members of the attending public. However, some lawful gun owners will not be allowed to participate.

To start, persons who either possess a Michigan issued Concealed Pistol License (CPL) or a "resident" CPL from his home state (See MCL 750.231a) which has reciprocity with Michigan will be able to lawfully carry a concealed handgun in Hart Plaza.

In 2002, Attorney General Jennifer Granholm clarified in Opinion #7120 that an "outdoor recreational park" such as Hart Plaza is not an "entertainment facility that seats 2,500" and does not constitute a Pistol-Free Zone under the Concealed Pistol License Act.

Further, I don't think any anti-gun politicians or law enforcement officers in Detroit or Wayne County would have the unmitigated gall to claim that Hart Plaza is a bar under the aforementioned statute, even if alcohol is being sold and served at the event. Thus, lawful conceal carry is authorized for this weekend's event at Hart Plaza.

Additionally, in the state of Michigan, it is unquestionably legal for a person - at least 18 years of age - who has his firearms rights intact to display a handgun - registered in his name - in a completely visible holster as long as he is on foot and he is not present in a statutorily defined "Pistol-FREE Zone."

Since Michigan law lists "An establishment licensed under the Liquor
Control Code" as a Pistol-Free Zone (See 750.234), unexempted persons under Michigan law are not able to carry a firearm at Hart Plaza this weekend because the Hoe Down has been issued a liquor license that lists both the upper and lower levels as the premises of the event. However, the very same statute lists Concealed Pistol License holders as exempt from the specified Pistol Free Zones.

Thus, it is only legal for the "average citizen" to carry a firearm at this weekend's festival at Hart Plaza - whether it is open or concealed - if he/she possesses a valid Concealed Pistol License. Obviously, the liquor license issued to the promoters of the festival is the issue preventing non-CPL holders from legally open carrying a handgun.

In my opinion, it is a shame that a promoter's livelihood or his opportunity to make a fast buck is going to potentially disarm a gun owner at this weekend's event. A potential compromise would possibly be to list only the lower level as the premises for the liquor license. Of course, pigs would fly first because alcohol sales are the revenues that financially "drive" the financing on this "free" event.

To make sure that readers of this post are absolutely clear, let me repeat: Open Carry and Concealed Carry of a handgun are both legal for this weekend's festival at Hart Plaza ONLY for people who have Concealed Pistol Licenses!

I have recently received word from Scott Webb, President of Michigan Open Carry Inc., that the Detroit Police Department has reportedly communicated that there is no firearms ban in effect at this year's "Country Hoe Down" in downtown Detroit at Hart Plaza. Accordingly, persons desiring to open carry at the aforementioned event should expect that Detroit police officers will not hassle or unlawfully detain them while exercising their right to bear arms.

Webb informed me that the news of open carry "being allowed" at the "Country Hoe Down" was communicated by Detroit Police Deputy Chief Tolbert. If there are any issues regarding Detroit police officers impeding the rights of persons while open carrying, they are asked to contact Michigan Open Carry Inc. directly at phone number (586) 913-1662. Reportedly, DC Tolbert will be on-location during the festival and will be available to receive communications from Michigan Open Carry Inc. if needed.

The Detroit "Country Hoe Down" is the largest free country music festival in the world and takes place every year at Hart Plaza. This year's festival will be held this weekend - May 13th throught May 15th. Featured acts - this year - include the following: Alan Turner & the Steel Horse Band, Josh Gracin, and Billy Craig.

Open carry (OC) is the act of displaying a handgun in a completely visible holster. OC is legal in 44 states in the US, including Michigan. Michigan is currently one of the fastest growing states in terms of OC popularity. As such, the practice will continue to grow both state-wide and in the city of Detroit.
