FAQ: Are Royal Oak, Michigan Restaurants Pistol-FREE Zones?

Q: Hey Rick, I'll be moving to Detroit in June to start my new job. Are places like Woody's Diner and Cantina Diablos considered bars or restaurants in terms of legal CCW carry? Thanks!

A: To be honest, I sincerely do not definitively know the answer. I have not visited either venue in person but I did drop by their web sites. Both sites on the Internet made it clearly known that alcoholic beverages are sold on the premises.

The issue at hand is whether any particular eatery makes or grosses at least 50 percent of its revenues from the sale of alcoholic drinks. If it does, then it is legally a concealed carry pistol-free zone. However, other places which are clearly restaurants (e.g. Big Fish, Olive garden, and etc.) which sell alcohol are not conceal carry gun free zones.

Accordingly, my politically correct answer is that you should assume that both of your mentioned venues are gun-free zones. Having said all of that, one could push the envelope and conceal carry there anyway and make your case about the venue's balance sheets to law enforcement, the local prosecutor, and the judge if you are discovered.

I ask that you make your best possible decision and where appropriate err on the side of caution. Finally, whatever you do, do not drink while conceal carrying your firearm.
