Can You Legally Shoot A Car Thief In Michigan?

One big story that is being discussed today is the shooting death of an alleged car thief on the southwest side of Detroit. From statements issued by persons quoted in the story, it appears that some people in our community don't know if it is legal to use lethal force to defend personal property.

In Michigan, lethal force is justified when a person is somewhere he has a legal right to be, is not in the commission of a crime, and has a reasonable and honest belief that he is facing imminent jeopardy of severe bodily harm, sexual assault, or death. If a person uses lethal force outside of those legal boundaries, he is likely to face criminal charges.

From several news accounts of the story, the homeowner claims to have been targeted for theft a few times over the past couple of months. In the aftermath, he claimed that he took extra precautions, such as not leaving anything of value in his vehicle.

On Tuesday morning, the homeowner allegedly discovered two persons in his car which was parked in the back yard. He then fired "warning shots into the air to scare the would-be-robbers away, but when one suspect returned to pick up something he dropped, the homeowner shot at the suspect."

It wasn't until the homeowner talked with local police officers that he discovered that one of the would-be car thieves was killed and another one was shot. This fact does not bode well for the shooter. If you shoot someone, it should be because you intended to do so and have a lawful and articulable reason for doing so.

In my opinion, based on what has been reported in the media, the homeowner will likely face criminal charges. To start, the shooter appears to incriminate himself of the act of firing warning shots into the air. Warning shots are almost never justified. Every fired bullet must come to rest somewhere. Accordingly, those falling bullets presented a potential threat to other members of that southwest Detroit community.

Moreover, the mere act of firing warning shots implies that the shooter was not under an imminent threat because if he was facing a serious threat, his time and energy would have been better served shooting his attackers and not trying to scare them away from his property with gunfire.

The mere act of scaring a person, who does not present an imminent threat to you, with a firearm could result in unlawful discharge of a firearm, felonious assault, and felony firearm charges.

Toss in the fact that he eventually shot two persons - one of which who died - upon their return to allegedly retrieve an errant shoe and the shooter might be also facing an open murder charge. The shooter's fate on the potential murder charges will hinge upon his statement and the statements of the other alleged car thieves.

Unless the shooter has a verifiable or credible story as to how his life was in jeopardy during both stanzas of this lethal force encounter, he's going to eventually end up in prison.

Of course, I suspect that there is more to this story than has been published in the media. Personally, I find it hard to believe that two would-be car thieves who were chased off by gunfire - legal or not - came back to the scene where a known and armed homeowner was located. It doesn't make sense to me.

For the record, you can't use warning shots to protect personal property in the state of Michigan. However, there's nothing technically wrong legally to use less than lethal force to protect your personal property. Thus, if you are ever under these circumstances, use your best judgement that does not place you under danger of being harmed or having to answer to the judicial system for having improperly used lethal force.

I believe the homeowner is going to prison. What do you think?

Can You Legally Carry A Handgun Into A US Post Office If You Have A Michigan Concealed Pistol License?

Locally, interest on the subject of carrying a firearm in a US Post Office gained in popularity due to a recent shooting incident in Detroit. In that event, it was reported almost a week ago by the local media that an 81 year-old retiree of the Detroit Police Department was attacked by a carjacker as he exited a post office.

At some point during the attack, the retiree produced a handgun and fired several times at his attacker while being struck by a bullet from the attacker's firearm. Although it was not specifically mentioned, there is speculation that the retiree may have had his firearm on his person while in the post office.

A question on the minds of many folks who read that story is whether it is legal to carry a handgun in a post office.

Coverage of pistol free zones (PFZ) - places where certain classes of people can't legally carry a firearm - is addressed in the state of Michigan compliant Concealed Pistol License (CPL) classes that I teach. One such PFZ is US Post Offices.

US Post Offices are federal property and are not specifically addressed in Michigan law. As such, they are not conveniently listed as PFZs on the back of CPLs issued by the state of Michigan. However, the topic of firearms and whether they are allowed on US Post Office property is covered under federal law.

Code of Federal Regulations - Title 39 - Chapter 1 - Part 32 is entitled "Conduct On Postal Property."

Section 232.1(l) states:

Weapons and explosives. No person while on postal property may carry firearms, other dangerous or deadly weapons, or explosives, either openly or concealed, or store the same on postal property, except for official purposes.

Some folks have reasoned that if they are lawfully carrying a firearm on their person then merely either being on postal property or entering a postal facility satisfies the phrase "for official purposes" in the aforementioned law. Moreover, these same people ignore the "No Guns Allowed" sign at the entrance while blissfully believing that if they were ever caught a jury of their peers would vindicate their actions. In essence, they would be willing participants in the first known test case on this area of the law.

On October 14th, 2009, the US Court of Appeals for the Fifth Circuit upheld the conviction of Clarence Paul Dorosan for violating 39 C.F.R. § 232.1(l). Dorosan, a US mail carrier, was specifically convicted originally for storing a handgun in the glove box of his car while it was parked in the lot belonging to the US Postal Service.

Thusly, if a person is carrying a firearm either onto or into US Post Office facility with the understanding that he'd be a willing participant to be the first test case, he'd be mistaken. We all now know - at least until a higher court overturns this ruling - that carrying a firearm onto or into postal property is settled case law.

As for the retiree mentioned above, he'll probably be okay. He's a senior citizen and an ex-cop. I suspect nobody is "officially" asking and discussing whether he had a gun while on postal property. You and I under similar circumstances may not be so lucky.

Michigan Handgun Open Carry Quiz

A buddy of mine is a ranking police officer in a local law enforcement agency. As part of his duties, he has to conduct training on a wide variety of topics, including firearms law.

Last week, my pal gave me a test he had previously written and had just administered throughout his agency. I thought it was a "fun" exam so I asked if I could post it on my blog; no need to create my own quiz, I thought. Now that he has recently received authorization from his superiors allowing me to distribute it, I am officially posting it.

So, take the exam and see how many you can get correct. Enter your answers as a comment. If in doubt as to the "intent" of a question, assume the posture and/or position of a Michigan local law enforcement agency.

A Few Observations on the Carjacking of the 81 Year-old DPD Retiree

Believe it or not, I actually read all of the emails that are sent to me. Time constraints preclude me from responding to all of them. However, when I get several communications on a specific topic, it is not uncommon for me to blog about it. After all, as a blogger, it is my function to discuss things that are important to you - my readers.

As such, many of you wanted to discuss and to solicit my feedback and observations on the 81 year-old Detroit Police Department (DPD) retiree who was car-jacked a couple of days ago. Unless you live under a rock, you have heard the reported details on the story in the media.

This past Monday Mr. Moses Baldwin, a 26 year veteran of the DPD, was shot during a robbery of his vehicle as he was leaving a post office on the east-side of Detroit. During the incident, Baldwin was shot in the shoulder at some point in time during the incident.

He was dispatched to an area hospital where his injury was reported as not being life threatening. Additionally, Baldwin managed to discharge his revolver four times. It is known whether his assailant was injured. Baldwin's vehicle was recovered some time later with the bad guy nowhere in sight.

Although, there are many things that we - the general public - do not know about this story, I will share my observations based on what has been publicly reported in the media.

Observation 1: Bad Guys Love To Attack Senior Citizens

Robbers and carjackers prefer easy victims. Many times, those easy victims are senior citizens. It doesn't take a stretch of an imagination to conclude that the bad guy in this story saw Mr. Bladwin, a man 81 years of age, and sized him as a person to be victimized without fear of reprisals. I smirk when I imagine the expression on the face of the bad guy when his victim pulled out a revolver and started shooting in self-defense.

Observation 2: Violent Crime Can Happen In Broad Daylight

Mr. Baldwin was assaulted during the day. The estimated time of the attack was reported consistently in the media as noon. As such, citizens would be well-advised to be alert and vigilant at all hours of the day. Further, citizens should not take any solace and umbrage that there may be bystanders present. Bad guys go about their business of violence, robbery, and pillaging regardless of others being around.

Observation 3: Bad Guys Love Pistol-Free Zones

Post offices are federal property. As such, they are pistol-free zones. There is no better place for bad guys to select targets for victimization. Bad guys assume that law-abiding citizens will obey the law and as a consequence be helpless. After all, bad guys by definition do not obey the law. Incidentally, no one reporting the story's details bothered to mention exactly how the "victim" managed to have a revolver as he was leaving a pistol-free zone.

Observation 4: Armed Victims Can Get Shot During An Attack

Carrying a firearm for personal protection is no guarantee of not being harmed. A handgun is not a good luck charm that causes bad guys to disappear when it is drawn. However, it does afford a victim the opportunity to defend himself. Without it, a victim's fate is left to chance and in some cases the marksmanship - or lack of it - of the bad guy. All things considered, I'll continue to carry my guns and preserve my chances of defending myself as opposed to not being a factor in my welfare.

Observation 5: Emphasis Erroneously Placed On Victim Defending His Car

In several versions of this incident, I read a few quotes in which it was stated that the victim had a right to defend his property. That is patently false in the state of Michigan. A defense being used while under the imminent threat of a carjacking is not a defense of that person's property - the car. Rather, the use of lethal force is a valid and lawful defense of that person's life. A carjack victim is defending his life - not his car.

I hope that many people who had heard of this incident do not make the mistake of brushing it off as something that couldn't happen to them. It is only too easy to come up reasons why it couldn't happen to them as it happened to Mr. Baldwin:

• It happened in Detroit.
  
• It happened on the east-side.
  
• It happened because he's old.
  
• It happened because he had a nice car.

It can happen to you. Are you going to be proactive about your personal protection? Or are you going to leave it to fate, chance, and poor marksmanship of the bad guys on the street? Whatever you think, you're going to have to live - or not - with your decision.

Further, some suggestions will be made for those citizens who decide that they want to take a more active role in their own personal protection in light of the recent decisions made by local policy-makers downtown. Detroit Concealed Weapons Permit Teacher's IHOP Boycott Site Nets 800th Supporter

Detroit, Michigan -- June 7th, 2011 -- Detroit, Michigan Concealed Weapons Class Teacher's Protest Site Against Local International House of Pancake Restaurant (IHOP) Nets 800th Supporter.

The "Boycott The Detroit IHOP - Crime Empowerment Zone" Page, an anti-IHOP presence on social media giant Facebook has just netted its 800th supporter. The boycott site was created by a local Michigan Concealed Weapons Class Teacher, Rick Ector, in response to that local restaurant's active ban on the possession of all legally carried firearms - openly carried or lawfully concealed carried with a state of Michigan Concealed Weapons Permit.

In the state of Michigan, the open carry of a pistol in a visible holster is legal without a license, as long as the carrier is 18, the carrier is on foot, the carrier avoids pistol-free zones, and the pistol is registered to the carrier.

Ector supports the local IHOP management's right to ban gun-toting patrons from its premises. He stated, "I am an ardent supporter of private property rights. However, I am also a strong supporter of the First Amendment, as well as the Second Amendment. If they don't want lawful firearms owners dining there, I will get the word out and encourage them not to patronize that establishment. We now have 800 supporters; the message is reaching our market."

Desperate Muskegon Police, Religious, and Community Leaders Openly Admit Folly of Their Upcoming Gun Buy-Back Scheme

An online news story today is reporting that Muskegon police, religious, and community leaders have scheduled a gun buy-back event to occur on June 25th at a local church. This scheme was hatched, reportedly, as an official response to a spate of violence in that city; there have been five shootings in that region over the past couple of weeks.

In my humble opinion, it is no surprise that a desperate city experiencing a sudden flare-up of violent crime would grasp at any available political straws to explain the phenomenon. After all, we've seen this dog-and-pony show in Detroit as recently as this past winter. Regrettably, the results in the aftermath of this con will be the same there as it has played out here - no impact.

For the gun buy-back scam to work, the city's leadership has to prey upon the ignorance of its citizens. In essence, an inanimate object - a firearm - is to be subtly blamed for the violence. Sure, the actual culprits - the criminals - will be prosecuted to the fullest extent of the law if they are ever apprehended. However, the 'real' blame for the violence has been projected onto the guns.

Thusly, the inevitable solution being sold as the answer to Muskegon's violence problem is to round up as many guns as possible and destroy them. After all, if guns are the source of the problem then removing as many of them as possible from circulation would make things better.

The dirty little secret about gun buy-backs that the police and the politicians don't want the public to know is that they do not work. Gun buy-backs have never worked anywhere at any point in time and will never work. They have absolutely no effect on crime. Even worse, the time and resources spent on conducting such activities is forever wasted instead of being used to tackle the real issues.

If the Muskegon-area citizens sheepishly go along for the ride, the city's leadership does not have to explain how they have failed their residents' expectation of being kept safe from danger. The real hard work of determining the root cause of the violence and what reasonable and effective steps to quell it will remain undone.

Predictably, the local police department will get their vaunted photo-op with the media cameras in tow. There will be some turned in firearms laid bare for all to see on an otherwise non-descript table. Only among the whispers of the badged arms collectors will it be told that many of the day's booty are old, rusted-out, and inoperable firearms that do not pose a menace to anyone.

The citizens of Muskegon deserve better. If that city's leadership can't come up with a real solution, they should collectively step aside and allow someone with a credible plan an opportunity to serve the public. In the story, the city's leadership was quoted as saying, "they know that the event won't stop the violence, but every little bit helps."

Why would anybody spend man-power, time, and money on a plan that he has already conceded to fail? No credible explanation comes to mind other than desperation.

Detroit Firearms Instructor Publishes Free E-Book on the Michigan Concealed Pistol License
